This is Miami County's policy. 4.09 Compensatory Time A. FLSA nonexempt employees may request to take compensatory time off in lieu of receiving cash payment for overtime worked, at the rate of one and one-half (1 ½) hours off for each hour of overtime worked. Employees may also request to take compensatory time off in lieu of receiving cash payment for hours worked over the employee's normal weekly work hours but under 40 in a week, at the rate of one (1) hour off for each hour worked. Employees may accrue a maximum of 40 hours of compensatory time at any one time. All overtime hours worked in excess of the 40-hour limit shall be paid in cash. B. An employee must inform the supervisor at the time overtime is worked whether the employee wishes compensation in the form of wages or compensatory time. Failure to request compensatory time will result in overtime compensation in the form of wages. C. The employer may schedule an employee to use compensatory time off at a time mutually agreeable to the employer and the employee. Compensatory time must be used within the period established by the appointing authority. If the compensatory time is not used within the established period, the employee will receive pay for the overtime worked. Accumulated but unused compensatory time balances may also be paid out upon approval by the appointing authority. Employees shall request compensatory time off in writing on a Request for Leave of Absence form. Requests for compensatory time off two (2) days or less should be requested at least 24 hours in advance. Requests for compensatory time off three (3) days or more should be made at least two (2) weeks in advance. D. The employer shall grant requests for scheduling compensatory time off if the requested time does not create an unreasonable hardship to the employer. E. Bargaining unit employees shall be granted and may use compensatory time in accordance with the applicable collective bargaining agreement.
