Review the lay-off and job abolishment process for classified employees ORC 124.321 to 124.328. Lack of funds is "presumed" for those positions funded under grants (found that in a training handout from Downs Fishel Hass Kim from Oct 09). The employee must request or CONSENT to reduce their hours from their standard work week, or reduce their hourly rate, at any time or in lieu of a lay off. The tenuous nature of continued funding would not determine classified or unclassified status. ORC is pretty specific ... depending on the county department or agency. In particular, can this be done under the provisions of ORC 124.321 and 124.34 regarding classified employees? On another note, can employees paid from a grant be unclassified simply by virtue of the tenuous nature of continued funding for their position?
