In Erie County, we can't think of a case where we have sent a COBRA notice to an employee in active pay status. As long as an employee is in active pay status, we will deduct their contribution. Once out of active pay status, if they are on an approved leave, they will pay their portion by check or money order to the Auditor, and remain on the plan. David W.
