At Richland County, we pay Wage Continuation for up to 4 weeks, so those weeks are treated just like the person is working. After that, if an injured worker is still off work, he/she would draw TT from the BWC and pay their portion of the insurance out of that. If the injured worker stops paying his portion, he is put on COBRA. Here's the response from the Benefits Department: We receive documentation from a department stating when the FMLA is exhausted, or when the employee becomes inactive on payroll. At that time, we send out a COBRA notice to the employee. We deal with the issue on case by case basis. The only time that we have required the injured worker to pay for their share of the health insurance was after we have stopped salary continuation and they began to draw compensation from BWC. In Trumbull, we continue to cover the person for the duration of their leave, as long as they stay current with their premium share. If they fall behind in payments, they are removed from the plan and offered COBRA. In Erie County, we can't think of a case where we have sent a COBRA notice to an employee in active pay status. As long as an employee is in active pay status, we will deduct their contribution. Once out of active pay status, if they are on an approved leave, they will pay their portion by check or money order to the Auditor, and remain on the plan. David W. If Injured Worker (IW) is off on Temporary Total (TT), FMLA is offered for 12 weeks after that is exhausted w/ no return to work the IW is offered COBRA.
