All- Here is the Fairfield County policy. SECTION: 4:8 SUBJECT: PRECINCT ELECTION OFFICIAL LEAVE An employee who is a resident of Fairfield County and is not an elected official or a public school teacher may request paid administrative leave to serve as an approved precinct election official on the day of an election. However, nothing in this policy supersedes or negates any provision of a collective bargaining unit. - 64 - The employee must obtain written authorization for paid administrative leave from his or her appointing authority, department head, or designee, prior to contacting the Board of Elections to register as an official of an election, if paid administrative leave on Election Day is desired. The appointing authority, department head, or designee reserves the right to reject a request based on operational need. Should several employees apply who perform similar functions and operational need dictates that not all may participate; priority shall be defined and given by the appointing authority, department head, or designee, with a procedure that is applied uniformly to all similarly situated employees. The Board of Elections reserves the right to refuse to place an employee as a poll worker on the day of the election. In such an instance, the employee must report to work during the employee's regular work hours. The Board of Elections may give priority to employees who have served as officials in prior elections. The employee may be required to attend training courses as mandated by Ohio Law and conducted by the Fairfield County Board of Elections. The employee must attend said training courses as required by the Board of Elections, of which there are options that are outside the traditional working hours. Paid administrative leave is not applicable for the required training. The normal Election Day workday is 6:00 AM until 8:00 PM, or until all election responsibilities are completed. The employee's prompt return to work on the employee's next regular working day is expected. An employee using paid administrative leave to serve as a Precinct Election Official is entitled to paid administrative leave plus compensation designated by the Board of Elections based on the assigned election official duties. The paid administrative leave in this case is not considered "hours worked," for the purposes of computing overtime. An employee would be eligible for paid administrative leave for their regularly scheduled hours of work on the day of the election. Employees in the classified service are prohibited by Section 124.57 of the Revised Code from engaging in political activity. (1) Classified service means all persons in the classified civil service of the County, whether in certified or provisional/probation status. Unless specifically exempted from the classified service in accordance with the Revised Code, an employee shall be considered to be in the classified service for purposes of this policy. The Appointing Authority may initiate such removal action in accordance with the procedures in Section 124.34 of the Revised Code. e) Employees in the unclassified service, who serve at the pleasure of the Appointing Authority, are not prohibited from engaging in political activity unless specifically precluded by federal or state constitutional statutory provisions or prohibited by the Appointing Authority. f) Classified employees may serve as a precinct election official for a primary, special, or general election, and the employee may, with the prior approval of the Appointing Authority, use vacation leave, compensatory time off, unpaid leave, or Precinct Election Official Leave (if such leave is established by the Appointing Authority). g) Service in an appointed or elected position is prohibited when such position is subordinate to or in any way a check upon a position concurrently occupied by a classified or unclassified employee, or when it is physically impossible for one person to discharge the duties of both positions, or if some specific constitutional or statutory bar exists prohibiting a person from serving both positions. h) If any person holding public office or employment is convicted of violating the Revised Code provisions prohibiting abuse of political influence, such office or position shall thereby be rendered vacant.
