FW: Workers' Compensation/Salary Continuation
Good Afternoon, Happy Monday! If you have a minute, we would appreciate knowing your practice for workers' compensation regarding salary continuation. Does your county use salary continuation? If so, what is the maximum amount of time an injured worker can receive salary continuation? If any, what other parameters are tied to the use of salary continuation (injured worker must use doctors from a provider panel, etc.)? What type of premium do you pay, i.e. individual retro, group retro, etc.? Thank you in advance for your answers. Have a great week! Michelle Michelle R. Noble Director, Clark County Personnel 50 E. Columbia St., PO Box 357 Springfield, OH 45501 937-521-2008
I encourage all our offices/departments to use salary continuation, but I want the opportunity to review each claim to make sure salary continuation is appropriate. Some of our offices use it; some do not. We are on group retro. Hardin uses salary continuation a lot, but on a case by case basis, as the BWC allows. We are in Group Retro. Each Department Head and/or supervisor of the injured worker and I discuss each potential salary continuation claim, sometimes with our TPA and MCO's input, and arrive at what we feel is an appropriate amount of time to pay salary continuation. The time can be extended if we agree it is necessary. When I started ten years ago I thought paying salary continuation might encourage "look alike" claims, but that has not seemed to have developed. I would add that when we are faced with an apparently long-lasting lost time claim, we may just go ahead and let the BWC do temp. total payments. In Erie County we are Individual Retro. We believe in wage continuation. The Commissioners' Personnel Policy Manual says Wage Continuation will be offered to eligible employees (those meeting BWC eligibility requirements). The employee may elect wage continuation or not, but it is generally offered for at most 4 weeks (two weeks initially, renewable up to four weeks). In practical terms, cases would be judged individually as it would be financially advantageous to pay a few more days to avoid a "lost time" reserve on the claim. Elected officials may or may not choose to follow the recommendations of HR staff as they would be the ones to sign a C-55 (the document to authorize wage continuation). Generally we consult with our TPA about when and how long we will recommend wage continuation, but the elected official has the final say and they pay their own share of the BWC premium based on their allocated costs. Michelle, Defiance County utilizes Salary Continuation on a case by case basis. Our policy states "For a period not to exceed 12 weeks". We review the claim every 30 days to determine whether or not to continue the salary continuation or determine if we can bring them back on some type of transitional duty. We have offered Transitional Duty for employees that could work from home or for as little as 2 hours a day in the office and gradually bring them back to a full day. We currently have an employee on salary continuation that will be paid for at least 6 months at the request of their elected official. This is the first time we have had a request like this. It was the elected officials decision to pay the salary for the entire length of medical leave with no transitional duty offered. We are new to Group Retro. Julie Julie A. In Trumbull, most of our departments have salary continuation, from 120 days in the Sheriff's, to a full year in our largest AFSCME unit. There are a few (ODJFS & Highway) which do not participate in salary continuation. As long as the doctor certifies the employee is unable to work, salary continuation continues. It comes to an end when the doctor releases the injured worker to return to work or the time limit expires. If an employee exceeds the continuation time period, they are to apply for TT from the Bureau. We are in individual retro.
