On December 3, 2018, the State Board of Pharmacy announced that Ohio's medical marijuana patient registry is now operational. The notice further advises that dispensing of medical marijuana will be begin in the coming weeks or months. As you may know, use, possession, or distribution of medical marijuana violates the Drug and Alcohol policy contained in CORSA's Best Practice Personnel Policy Manual. Medical marijuana is still illegal under federal law. Under Ohio law, employees may be ineligible for unemployment and/or Workers' Comp. State law also does not prohibit employers from refusing to hire, discharging, or taking an adverse employment action because of a person's use of medical marijuana. Employee inquiries are likely to increase as Ohio's medical marijuana program comes online and medical marijuana is dispensed. If you have not done so already, now is a good time to consult your drug and alcohol employment policies, make necessary changes (if any), and educate supervisors and staff.
